I spent one year at the institution I matriculated at, then took a year off to take classes at a bad state school (as a non-degree seeking student). For the purposes of transferring, am I a sophomore or a junior?

If I'm a junior, then would I still be a junior if I applied to really tough schools that wouldn't accept my state school classes for credit?

I believe your academic standing is based on how many transferrable credits you will have. 60+ semester hours (or 90+ quarter hours) will make you an upper-level transfer. Less than 60 hours will make you a lower-level transfer.

I think what you’re asking is if you’re a junior, could you have some of your credit not accepted? Sure - many schools require you to spend either 4 semesters in residence there to graduate and/or you to attain at least half the credits for a degree and/or half the credits in your major at the school. You’ll have to read about the school’s specific transfer policies.
