California In-state Tuition (Condit perhaps?)

I am currently working in Los Angeles and paying California taxes for the past year. I have a California residence and my car is registered in California. My daughter is finishing high school in another state because I don’t want to move the kids in the middle of high school. It seems as if her residence currently is in the other state because that is where she is spending most of her time.

According to the rules here: http://www.ucop.edu/general-counsel/_files/ed-affairs/uc-residence-policy.pdf it seems that my daughter can qualify for in-state tuition if she moves into my CA residence before she turns 18 (which occurs in her freshman year of college) according to paragraph E on page 43.

Does this make sense? If I am living in CA and paying taxes here and paying 100% of the bills (my wife doesn’t work) then she should qualify for CA tuition in 2 years.

I think it will, but keep very good records because, since she isn’t graduating from a CA high school, it probably will be questioned.

I’m not sure it would take two years. You moved there for your job, right?

When did you move there?

Is your D a senior? Did she apply to any Calif schools?

I don’t think she’d qualify for Cal Grants (your income may be too high anyway) since she didn’t go to a Calif high school.

We spoke to someone in the registrar’s office and she said “yes” but keep very good records. Items of note:

Where is car registered?
What state drivers license do I have?
When I file my taxes is the CA return a resident return or a non-resident return?
Where am I registered to vote?

Did she say when the residency review and determination would occur? I’m just wondering if that will be too late for the student to get another school if it is done late. May require a gap year. Continued residency would of course be needed to maintain the instate rates. Anything to show intent to stay would be good. I’m surprised they didn’t mention a lease or rental agreements and payments so don’t neglect that, it has been asked for in the past. Of course you realize that many people are desiring instate rates and go through all sorts of hijinks to get it so they are looking very closely.
