can't file taxes because IRS forms are not finalized

My software has form 8829 with a 2010 date, but it isn’t printable.

Chances are the CSS Profile schools will disallow many of the form 8829 deductions as “phantom” deductions anyway. :(

That’s what mine has. I assume it’s based on the draft published by the IRS (which is identical to the 2009 form as far as I can see). I still haven’t figured out what it was that was possibly changing on that form that caused it not to be finalized originally. Whatever, I hope they’ll finalize the form on Feb. 3. Then even if my software won’t generate a printable version yet (their next update is slated for Feb. 14) I can use their fillable PDF to create it by hand.

The schools are welcome to disallow whatever they want, of course.

MIT very reasonably says that if you can’t file your taxes by Feb. 15th to mail a copy of your 2009 taxes straight to them, and then send the 2010 taxes through IDOC when they are ready. I asked if in my case (2010 is basically done and 2009 is not as representative) if I could also send my draft 2010 return and they agreed that that makes sense.

No update from Cornell yet and I haven’t heard back from CMU. But I’m going to wait and see if that form appears on Feb. 3 before trying to get on the phone with either of them. (By the way, I now have a 3rd possible date – the Free File Fillable Forms chart says that that form will be available there on the 7th, which, if true, will also allow me to send my final taxes in time for the 15th as long as the warning about needing 2 weeks processing time for IDOC was overstated.)

Another update: I heard back from Cornell and they stated that missing the Feb. 15th deadline will not reduce my son’s aid eligibility but may make it difficult for them to get an award letter to him prior to May 1, depending exactly how much later the forms get to them. Presumably in that case missing by a few days would not be the end of the world, but I’ll still do everything in my power to make sure they get it in time.

My TurboTax update this morning claims to have the final form 8829. Good Luck.

Hmm, the IRS still does not have the 2010 copy of 8829 up on their website yet, but you make me hopeful that I will be able to get a copy somewhere shortly. H&R Block software says it is not planning to update again until the 14th but if I can get a copy of the form from the IRS website or Free Fillable Forms I’ll be all set. I’ll go out and buy TurboTax if necessary! Thanks for letting me know :)

Can someone clarify this for me. I want to know when the school says they won’t be able to give us a decision until we send the 2010 taxes in are they only referring to the financial aid award? Will this also delay the decision to admit them to the college? Are these two items completely separate?

In case anyone else is waiting for it, the 2010 final form 8829 appeared on the IRS website today. http://www.irs.gov/pub/irs-pdf/f8829.pdf</a> phew :)
