do I have to file a New York state tax return

<p>I am a New York high school senior troubled by the Fafsa. Anyway, I have a part time job after school, making about $144 a month for $6/hr. I have no other source of income and when I start college, I will have to quit the after-school job. My parents support me. I am pretty sure that I don't have to file a federal tax return, but not sure if I have to file one for New York State. For people in New York state with similar situations or for people who know the answer, please tell me if I have to file a state tax return.</p>

*I will be turning 18 in about 2 days, but I still am considered a dependent (according to Fafsa).
*My part-time job is after-school tutoring. Since I make so little, my employer pays me (and the other employees) in cash and does not file a W2 or anything for me.<br>
*I started September 2006 and will quit most probably during the summer before college starts.</p>

<p>Kevin I've had to file for all my kids including my present daughter when I was in NYS. If you get a W-2 then I think you must file but use the 1040 EZ return. High potential you get any taxes paid back.</p>

<p>The tax form and worksheet on the back will recognize you as a dependent and calculate accordingly.</p>

<p>My employer is not giving me any W2 and I don't want any taxes paid back to me. I just want as little trouble as possible for me and my Fafsa.</p>

<p>Could it be that this poster was paid "under the table"? If so, this income would not appear on a W-2 or on a tax return. I don't know about NY, but in CT you don't have to file a state return at your income level unless state taxes were deducted from your pay. If you were receiving cash for your pay, it's unlikely any deductions for anything were taken out of your earnings. Why don't you ask your employer? Our daughter earned about as much as you babysitting. She did not file taxes for that money earned...no w-2 forms for babysitting.</p>

<p>I think paying "under the table" means paying in cash. My employer does pay me $36 in cash weekly. I take home all the money I make from tutoring and am not subject to any deductions. Basically, no one really knows I am a job, but the problem is that on my college resume I put my job down. So, do I still have to file a NYS tax return. I don't have to file a federal tax return though.</p>

<p>Kevin, I think paying under the table means your employer didn't report your income and mess around with all those trivial things like FICA, state tax, workman's comp,disability ect. Basically since it was steady employment as opposed to just a situational only thing it wasn't very legal. Good thing nothing happened to you while on the job. Babysitting is a bit different situation.</p>

<p>there are federal and state taxes. you take care of both when filing urs. second since ure a dependent u dont file ur taxes ur parents do. if u get any W2's u give them to ur parents and they are supposed to include that money when filling taxes.</p>

<p>I really am very aware of all the procedures of the tax return things.I know my parents have filed their federal tax return, but I am not sure if they have done the same thing for the state tax return. If they are supposed to file both the federal and state tax returns at the same time, then I think I have filed them. Since I don't have a W2 and am a dependent, I don't file a New York State tax return. Is that right?</p>

<p>This is absolutely NOT true. Just because you are a dependent does not mean you are absolved from your responsibility to file your own taxes if you are required to do so. In fact, most students (and they are dependents) DO file both federal and state taxes simply because the taxes that were deducted from their earnings will be refunded to them. So...even IF you are a dependent, file your taxes....unless you didn't have a job. If you didn't have a job then you do not need to file.</p>

<p>Kevin...I do not know the criteria for filing in NY. I'm sure if you go on their website, there will be something that tells you if you need to file. I only know about CT. I think you first need to talk to this employer and find out what he/she did in regards to your earnings. Then check the NY website. You should be able to find out who needs to file and who does not.</p>

<p>In NY you do not have to file if you earn under $3000 if you are single and claimed as a dependent.
However Ray 111 was correct, your employer is not paying you and your fellow employees in cash "because you make so little", he is doing it to avoid paying payroll taxes.</p>
