ED and rolling admissions.

Lets say a student in August applies to a rolling admissions state school and gets accepted by early sept, but does not put any deposits down. Then they retake the SAT/ACT, do great, and decide they want to go ED now to a top school. Are they not allowed to, because they already have acceptance somewhere, even if they did not commit.?

ED generally only restricts applications at private schools. But, always consult an individual school’s policy.

Agree, unless it is against any type of restrictive policy of the ED school (which can be found on the school’s website) which is unlikely, then you are free to apply. Just recognize that if you get into the ED school you commit to attend.
