ED rules are about to undergo some changes?

“The counselling association” below refers to the National Association for College Admission Counseling:

The counselling association’s current guidelines discourage offering incentives beyond an early response. But colleges have been known to make indirect suggestions of benefits, such as higher odds of acceptance and greater certainty of access to limited amounts of the institution’s pot of financial aid money.

Such benefits are widely understood to confer an advantage upon students and families with the greatest familiarity with colleges and their admissions processes, and thus short-change students from poorer and non-white backgrounds.

The changes proposed by the Trump administration could widen that income- and race-based opportunity gap, by making clear that such incentives are fully permissible and by encouraging all colleges to keep offering such incentives even after a student accepts an admissions offer at a different institution.

Nothing final yet, NACAC membership will vote next week…but are expected to approve the changes. The changes have been proposed in order for NACAC to avoid DOJ seeking a consent decree to force said changes…the administration believes NACAC’s current rules harm students by limiting their choices. NACAC members did vote this morning to remove 3 provisions in their Code of Ethics:

At the 2019 National Conference meeting in Louisville, the NACAC Assembly voted this morning to remove three provisions from the association’s Code of Ethics and Professional Practice (CEPP) that the US Department of Justice (DOJ) believes inhibit, to some extent, competition among colleges for students. The three provisions address offering exclusive incentives for Early Decision, recruiting first-year undergraduates who have committed elsewhere, and recruiting transfer students.

NACAC will resume its discussions with the DOJ to ensure that the investigation is resolved as swiftly as possible. Association leaders are confident that NACAC can and will remain a champion for the ethical practice of college admission and a steadfast advocate for protecting students in their transition to higher education.

“By voting to remove these provisions, the association has demonstrated good faith in our effort to comply with the department’s investigation,” said NACAC CEO Joyce E. Smith. “In so doing, we remain committed to finding ways to best serve students, secondary schools, and postsecondary institutions in the transition from secondary to postsecondary education.”
