I am applying for FAFSA for the year of 2015-2016. My parents have filed as Married but filed separately.
My question is I am dependent on my Mom. Can I list her as a parent if she is illegal, makes little income, has no SSN, but does pay taxes.
I’m a freshman in College already so 2015-2016 is for my Sophomore year. But for my freshman year I put my step dads information not my moms will this affect me in any way.

If your parents are Married you have to use both combined incomes for FAFSA. Your mother and your step father.
If she doesn’t file for taxes chances are it won’t really affect you.
Huh? OP said that her mother does pay taxes. Anyway, it doesn’t matter what OP’s mother’s legal status is for FAFSA purposes; she must be listed on FAFSA and her income must be reported. Just because OP may have completed the form incorrectly last year doesn’t mean it’s OK to do so again this year.
