My ex-wife and I were separated in July 2012, but our divorce wasn't finalized until January 4th of this year, so we could still file our taxes as "Married Filing Jointly."

I have relocated to another state and the kids are living with mom, whose income is significantly less than mine.

When completing the FAFSA, should only mom's income be included? Or because we chose to file as "Married Filing Jointly," do we need to include both incomes?

only hers. But if you pay child support, that should be included. I think spousal support may also get included.

Since you say that she earns a lot less than you, I’m guessing that you’re providing good support, right?..especially since it sounds like she’s doing the parenting since you’ve moved OOS.

Your wife is the custodial parent for your college kids if they reside with her. For FAFSA purposes, only the custodial parent income and assets are listed (yes, this includes support you provide, however). Your wife will not be able to use the AGI and Taxes paid amounts from your 2012 tax return because only HER share should be reported.

Keep in mind that some colleges use either the CSS Profile OR their own form to get financial info from the non-custodial parent. Check to see the requirements for your kids’ colleges.
