<p>Regardless, in some states (as someone else pointed out), intoxication nullifies consent. Argue all you want, the letter of the law says it’s sexual assault.</p>

<p>Right but… if they’re BOTH drunk then neither of them could give consent. Therefore, either both of them would be charged with assault or neither of them. Baelor made it seem as though ONLY women could be sexually assaulted because only they can refuse to give consent- or something along those lines.</p>

<p>I can tell you that a friend of my D’s almost lost everything due to a similar situation. Both were drunk- the girl claimed non consent- the guy was investigated for sexual assault. He was never charged but if the girl wakes up the next day and decides she really didn’t want to do “that” - it falls on the guy.</p>
<p>It’s true that intoxication nullifies consent. But that’s totally beside the point of the thread. Like I said before, I don’t think OP did anything wrong. I don’t think he needs to feel bad, and I doubt the girl he hooked up with is making a big deal out out it. Probably one of those "Oh man, I did what last night?"and then laughing, and then moving on. </p>

<p>And yeah, I’m not sure how the rape discussion started. I just asked the guy what exactly he did with this girl. Out of simple curiosity. I guess I wanted to just figure out how ‘awkward’ things could be between them.</p>

<p>man i come back 2 days later and this discussion took a dive off the deep end. just fyi, i did end up adding her on facebook, and we exchanged a couple of messages. she said she remembered bits and pieces but never responded to my most recent message. also, there were pictures of us on facebook where she would drag me into pictures (and i was obviously GONE in the pictures), but she took one of the down where it clearly shows us making out in the bathroom hahaha. i dont know man, i just felt bad…i dont like to be an a**hole but i felt that night i was. </p>
<p>i dont know. my friends call me an amateur, my other friends tell me i care too much. im just completely afraid of being that guy that the girl looks at and is like “omg i cant believe i hooked up with THAT while i was drunk” hence, this is why it was my first DRUNKEN hook up.</p>

<p>Also, drunken hookups in general are a bad idea, if only because they are very destructive to the idea of people as being more than a tool to find sexual gratification. But no one seems to agree with this, so IDK…</p>
