Help .. with In-state tuition

Hello,
I have lived in NYC for about a year with some vacations. I have to file for the in state tuition residency form at CUNY HUNTER COLLEGE. The problem is that I’m married and I can provide my husbands tax return as well bank statements with my name on it as proof … but i cannot provide my mother’s income tax return for the previous year as she hasn’t files one … she wasnt here. Will I be considered as an in-state student ?? please help … :frowning: i cannot afford so much tuition … Oh and yes, I got accepted for state and federal aid …

Is your H a NY resident? If so, then you are likely as well. Once you marry, you typically can claim residency in the same state that your spouse has residency. Your mom would be irrelevant.

I’m a US citizen … but on the form … in order to prove myself independent it requires my mothers tax returns stating me as independent… which i dont have since she was not present here

Did your mom file a tax return anywhere?

If you are married, you are most likely considered independent from your parent(s). At least that’s how it works for FAFSA.

@Madison85 My mother didnt file for some years because she lives out of country

@MiddKid86 yes, the fafsa went through its just the high amount of out-of-state tuition

yes she is

Did your mother work? If so, she was supposed to,file a return regardless of where she lives, I believe.

Another thought…were you married when your 2013 tax returns were done? If you were claimed and an exemption on your husbands and your joint return, I don’t believe anyone else can claim you. If that is correct, maybe the school will accept that.

She lived out of country. She does have tax returns from when she worked here, but they indicate me as a dependent…

What year is the tax return that indicates you were a dependent? 2012? 2013?

As a U.S. Citizen living abroad, I believe she is supposed to file a tax return if she worked, regardless of where. She would have a foreign income exclusion, and would likely not owe taxes, but she is still supposed to file.

Weren’t you a dependent BEFORE you married? They want to look at amounts, but if you have proof of your marriage, and most people do, all they care about is looking at the income on her 1040.

@thumper1 its very old because she moved away about 7 years ago and she couldnt file because she has to stay here at least 6 months in order to do that …

@aunt bea Yeah … i can provide them the very old tax returns of hers… but they still have me as a dependent … should i also submit my marriage certificate as additional proof?

It says this on the form… “The residency of dependent students (under age 24) reflects thats of his/her custodial parents regardless of how long the student has resided in the United States. To provide proof of independence students must submit their most recent Federal, NYS taxes and W-2’s AND their parents Federal tax returns.”

I read the NYS residency application instructions regarding applying for instate tuition. To prove you are independent (and thus your residency does not depend on your parents’ or parent’s residency), you need to submit your most recent tax return and your parent’s or parents’.

You have a problem because your U.S. citizen-mother who lives and works abroad has failed to file required federal income tax returns (see IRS Publication 54 at irs.gov website).

You may need to pay nonresident tuition if you can’t provide the required documentation. Or, wait until you are 24 to enroll at this NYS college.

Can you get your mom to file her 2014 (or 2013) federal income tax return? There is a foreign earned income exclusion which reduces her taxable income. How much does she earn?

she didnt know thats why she didnt file any …
