I am divorced. My daughter lives with my ex the most, so she is custodial parent and her info is used on my daughter's fafsa. My son lives with me the most, so he uses my info on fafsa.

I provide more than ½ of my daughter's financial support, so she can be a member of my household and another student on college on my son's application.

Here is my question: The instructions say The following persons are included in your parents household size:
*
Your parents other children, if your parents will provide more than half of their support from July 1, 2010 through June 30, 2011 OR if the other children could answer No to every question in Questions 46-58.

My son can answer no to all of those - so he counts as a member of my ex's hoousehold and college student on my daughter's application, correct?

Your son is not counted in your ex’s household, nor is he a college student on your daughter’s application. Let me also say that if both of your children attended my school, I would not allow you to do what you propose for your daughter. If your ex has your daughter in her household size, how can you have her in yours? Only one can provide at least half the support … which in FAFSA terms is FIRST the parent with whom the student has lived the most in the past 12 months. If you are providing child support, mom will be including that in HER untaxed income. She would also not be in your number in college. I know it’s confusing, but the test is “with whom did the student live the most in the past 12 months?” Only if that is not clear is “who paid the most” considered. The >50% support does throw people off … but just remember that a student can only be in one household & can only count as # in college for one family.
