is the homework grade curved for his class? or do you get whatever you score, I got a 9 and a 8 last 2 times which places me in a very bad condition if he curves it since hundreds of people got 10s...

It's the difference between whether or not an individual exam or subset or percentage of your entire grade is curved... or whether or not, at the very end of the course, it is curved from its entirety. Methinks the latter since it makes what, 10% max of your entire grade? At least, from my experiences, the latter has been consistent... with, of course, information about the standard deviations from the average midterms.

If anything, ask your professor if s/he curves @ the very end.

well homework is 20%, 2 midterms 20% each and final is 40% so are you saying that teachers don't curve on the specific tests, instead they curve the class in the end?

I said it depends and that you would have to ask your individual professor. Anecdotally, it has worked the latter.
