In-State Tuition

I don't live in VA, but if I apply for in-state tuition because of my parents, am I included into the in-state applicant pool during decisions? Or is it purely for financial purposes?

Your primary parents have to live in VA. We get a price break because we pay taxes. It’s a state school. If you are at boarding school but your parents live in VA you are a resident.

You qualify as in state for both admission and tuition purposes if ANY of the following are true:

You actually reside in Virginia, according to where you sleep the majority of nights in the 12 months previous to entering the university. Maybe your parents can adjust your custody schedule with this in mind? Keep a calendar and note where you spent each night.
You have a parent in Virginia who provides the majority of your financial support in the 12 months previous to entering the university.
You have a parent in Virginia who claims you as a dependent on state and federal tax returns.

If you claim inherited residency through a Virginia parent, they will be required to confirm their residency through residence, voter registration, vehicle registration, filed tax returns, etc.

The Common Application has questions that specifically cover inheriting Virginia residency from a parent when you do not actually live here yourself. Your in state status is determined before your application is read by admissions. It is a huge advantage to apply as a Virginia resident, you should definitely assert it if eligible. Read the CA questions for details.
