<p>Hello all, I'm gonna move pretty soon to the US to study EECS (undergrad) at Berkeley. However, since I plan on getting a job after graduation, I need to make sure that I have a H1 B visa.</p>
<p>The thing is my dad has a couple of really really close friends(both US citizens) in california who are willing to be my guardians. I was wondering whether it's possible for them to become my legal guardians and if so, whether this will help with my H1 B/green card applications. Thank you very much!</p>

<p>A legal guardian is a person who has the legal authority, and the corresponding duty, to care for the personal and property interests of another person, called a ward, because the ward is incapable of caring for his or her own interests due to infancy, incapacity, or disability. Since you are coming alone from overseas to attend Berkeley, I assume that you do not have a serious incapacity or disability that prevents you from taking care of yourself. Are you a minor – i.e., under 18 years of age? Otherwise, there’s no reason – and therefore no way – to create a legal guardianship. And even if you are a minor, you would be “emancipated” when you turn 18, so the legal guardian issue would become moot.</p>
<p>Legal guardianship is completely irrelevant to obtaining an H1B visa, because the H1B visa is strictly job-related. It allows U.S. employers to temporarily employ foreign workers in specialty occupations. There is absolutely no way “to make sure that I have an H1B visa” at this point in time. You’ll just have to take your chances and hope that after you graduate, you are lucky enough to find a job with an employer willing to do the paperwork to get the H1B visa. Also hope that the quota on H1B visas for that year has not been filled before you get yours.</p>
