i have seen two or more posts here in CC about a foreign exchange student who just lives in the USA even if the exchange program is over....is that legal? and will it change his/her status to a non-international?

MY understanding is that he or she would get a student visa, and would have to apply for a different classification. However, I’m pretty sure you cannot go from exchange student to green card in time to apply as a non-international.

Does having a student visa for high school help for admission in college?
and what you said about not having enough time for green card…how long will it take anyway? because im still a freshman…and i really really really wanna study in columbia or brown

Illegal Alien !!!

No, it’s not legal and will not change your international status. You would have to leave the US to even get a visa for college.

My sister was a foreign exchange student before. Unlike F-1 International Student Visa, a student with J-1 Student Exchange Visa has to live with a host family. If they drop out or finish the program, they have 90 days to leave the US. My sister was in high school and she was able to apply for F-1 visa and transferred to college but YMMV.

thanks guys… pure curiosity…

dang, i really wanna apply for a green card so that it would be easier to be admitted there for college…but im afraid 4 years wont be enough. :(

Under what circumstance? You can’t apply for a green card by yourself. You need a family member to petition for you which may take years.
