Parents plan move out-of-state upon HS graduation; can student get parents' NEW state residency?

Hello Dean, I hope you can give us some insight/suggestions. My husband & I plan to move back “home” to Dallas, TX, shortly after our son graduates from High School. Son is currently a High School Junior. We live in Ohio (have lived here 10 years now), but won’t likely move prior to his graduation due in large part to the following: son attends a highly regarded, large public Ohio school, and is Very near Academic top of Very large class. He’s Very strong in both academics and extracurricular activities. So husband & I both plan to keep working in Ohio until son graduates.
But, husband & I want to ‘move back home’ at that time, to be near extended family. We are very fortunate to have jobs that can relocate pretty easily. Our BIG question is: how/when can our son get In-State tuition in Texas, if we only just move there the summer after his High School graduation?

Who is Dean?

Each state has residency requirements and they can vary by college/university, so best to check on each college site. Essentially you will have to establish a domicile for 12 months

  1. Live in Texas for 12 consecutive months; and
  2. Establish and maintain domicile for 12 consecutive months, as evidenced by:

-Gainful employment in Texas; Note: Student jobs do not qualify as gainful employment.
-Sole or joint marital ownership of residential real property in Texas by the person seeking to enroll or the dependent’s parent, having established and maintained a domicile at the residence;
-Ownership and operation of a business in Texas; or
-Marriage for one year to a person who has established domicile in Texas.
