Since an antique gun is not required to be sold with a trigger lock, it would need to be stored "in a location which a reasonable person would believe to be secure". By the letter of the law, the parent did not do anything that would constitute negligence.

Today, everyone is willing to put the blame from someone else. We can't admit the fact that there are some stupid kids out there, so we'll blame the parents.
Raising a loaded firearm, aiming it at someone's head, and firing without justification is HARDLY an accident, no matter what liberal media would say. It is a crime. Whether the perpetrator is actually punished for his crime is another matter. It does not change the fact that he committed a crime.</p>

<p>This isn't about "shifting blame." This is about recognizing reality. Children do not have the same capacities as adults and we shouldn't consider them in the same light. </p>

<p>It has nothing to do with "stupid children." Parents are responsible for teaching their children firearm safety. Why should an 11-year-old be expected to know it otherwise?</p>

<p>The reality is that some children do not have the same capacity as other children. There are some children that you can teach firearms safety to but they will not be able to understand it. In this case, teaching firearms safety to the shooter would not have helped. He raised the gun to the other kid's head and pulled the trigger.</p>
