Found my answer. Sorry.

Most colleges that require that the writing section be included with the ACT do not provide a definitive answer on their on-line sites as to what they do when you submit both an ACT with writing and one without writing. Thus, to get a definitive answer you usually have to contact the particular college. For example, I know UIUC, which requires the writing section, will use an ACT without writing to determine admission if it has a higher score than one submitted with writing; in other words as long as you complete the requirement of submitting an ACT with writing you should also submit an ACT without writing if you have one with a higher score. Also, when I asked this question of Yale a few years back it said it would not consider an ACT without the writing section.
