This form is due tommorrow (yes I know I shouldn't have waited to complete) and my brother needs to sign it and also have the Registrar of his college sign it. However, he is graduating next week and I don't think he needs to fill it out. But the only options I see on the paper are:

"My family member ____ will not attend college at least half-time between July 1, 2011 and June 30, 2012."

"My family member ___ also attends UC Santa Cruz"

"My family member ____ is not currently attending college, but will enroll at least half-time beginning..."

And if the following does apply to him, he doesn't have to fill it out. But I am not sure. I'm guessing its the first option. Can someone help me out?

Yes, he needs to fill it out if you claimed him as a student on your FAFSA. Otherwise your EFC may go up significantly. You might ask for a short extension if he needs a few days to have the form signed.

If he is graduating, but he went full time, then he still qualifies for attending, right? So he should fill it out and have it signed. Can you fax it to the registrar?

Is this for the current school year (2011-2012)? If so, then you need to submit the verification documentation. Your FAFSA EFC will likely double if you initially said he would be attending school and you change it to say he is not.

If it is for the next school year, and he won’t be attending school in 2012-2013 school year, then of course that is the response you need to give.
