Title III Complaint

<p>Has any ever filed a Title III complaint under the ADA due to lack of accomodations at their public or private university?</p>

<p>It would be a section 504 of the Rehabilitation Act complaint.</p>

<p>My LD son filed a claim with the Office of Civil Rights against the Ca State college he was attending. The OCR determined there was enough evidence of non-compliance by the school to investigate. They did a thorough investigation and the school was found to be noncompliant in some areas. They had to make some changes as to how they treated disabled students. Unfortunately it was such a traumatic event for my son that he transferred the next semester. I was really trying to let him handle this on his own and not be a helicopter parent. In retrospect he needed my guidance and support because his school did not support him or advocate for him. At the very least I should have attended the interviews he was required to attend by a hostile administration.</p>

<p>He's in a happier situation now with a very supportive LD department.</p>

<p>That would be a Title II/504 complaint. </p>

<p>Title III covers private colleges among other things and is handled by DOJ. Title II covers state and local governments, and 504 covers recipients of Federal financial assistance. OCR has jurisdiction over all colleges receiving Federal financial assistance, public or private, under section 504, and public schools under Title II.</p>
