Will my rank hurt me?

As of last fall, i was 39th out of 619.

Basically what happened was for our class, our school decided to take off extra fractions of a point for advanced classes. So in freshman year, I got the hardest English teacher and most people got the easy one. So i got Bs both semesters and another B in a theatre class. I contested the B in theatre but there was never proof that i did turn in some assignment because my teacher had thrown everything away by summertime.

Then my school decided to add back the fractions of point for advanced classes for subsequent years and then whoever had As in first year would have the maximum 4.5 the school could give would keep it (about 90% of the 20 number 1s had the easy english teacher). Therefore after taking 6 advanced in sophomore year and 6 in junior year, i was 39th with a GPA of 4.44 / 4.5.

I probably have a top ten uncapped GPA but my school caps the gpa at 4.5 and then averages it to each semester.

My unweighted GPA is about 3.8/4.0

How much will that rank hurt me?

BTW, i am hispanic with 2340 SAT and am applying to HYPSM and Cal tech(not solely those but i am most concerned with them)

anyone ?

This is hard to say. There are no definite answers as to what will hurt someone's chances. There is a movement towards schools trying to look at students holistically, so that a low score here or there won't be the end all and be all. It sounds to me like you are doing okay, and schools definitely take into account the fact that you are taking higher/college prep type classes.
