Wrong Place at the Wrong Time

My friends in the dorms at SJSU were shining a laser pointer out the window in their room. Then University Police went to check on the room. My friend has weed, a pipe, a bong, multiple empty alcohol bottles, and a good amount of weed in the room, not to mention that he has a collection of knives and one that qualifies as a shank.

A few days later, I get an emailed letter, and there are four listed charges for me. Alcohol, Drugs, Weapons, and Violating Policy. My friends received the same charges, and an overall similar letter. Since I did not partake in any weed, alcohol, or possess any knives at all, how serious do you think it could get for me, when i go meet with the University Housing Code of Conduct services? Just want to see other peoples’ thoughts on the matter.

Who is this “friend” in relation to you? (e.g. roommate, suite-mate, or just some friend who lives in the same dorm)

Unless you can somehow prove that the alcohol/drugs were not yours or on your person, you’re in some hot water. I don’t know much drug possession laws, and I could be completely wrong on this, but I’ve read that generally if the items are “within your control” (e.g. lying in a public space or area as opposed to locked in your friend’s safe), you can still be charged with unlawful possession, even though the items are not technically yours.

Also, for your friends’ information, shining laser pointers outside (particularly at night) is a bad idea and people have been imprisoned for that.

He’s just a floormate, but I do hang out with him periodically. He has a marajuana card, and has released a statement that it is his, and his only.
