Am I a resident?

I personally own a property in Arizona that I am renting out. However, I live/go to school in California and paid my 2009 taxes in CA as well. I am thinking about transferring to ASU b/c the low in-state tuition costs but am not sure if I can qualify. I pay property taxes and insurance in AZ, as well as hold a valid AZ identification card. The house is in my name free and clear. This should qualify as 'intent to create domicile,' although the common app makes it hard to plead my case. What do you think?

Many thanks,

[Residency Classification for Tuition](http://www.abor.asu.edu/1_the_regents/reports_factbook/residency.html#Establish%20Arizona%20residency)

I don’t meet the first requirement. does that mean I won’t qualify? I have an obvious intent to domicile.

if you don’t meet the first requirement, you clearly don’t qualify. but you can stay for a year, then apply for residency after staying a year.

but there are a few secondary clauses…half a dozen of my ASU friends say i should have no problem, but i just can’t see how to fill out my application consistently

It’s pretty clear. Three basic requirements must be met:

 1. Twelve Months Continuous Physical Presence
 2. Intent to Establish a Domicile
 3. Financial Independence

Since you missed #1 you are not an AZ resident. As kemkid stated, you can go there for a year and get residency.

There are some exceptions. If you live within 75 miles of the AZ border or your parents live in AZ.
