Computer Expenses allowed for 529 plans in 2011?

<p>I've seen this subject debated on this forum, but have not seen anything recently. I've been searching around trying to find a definitive answer....but no luck so far. I called the IRS and talked to an agent who told me that the provision to allow computers as an eligible 529 expense has been extended for 2011. On the flip side though when I called the 529 plan administrator in my state (Ohio), I was told that the provision HAD NOT been extended and had expired at the end of 2010.</p>

<p>It still specifically mentions only 2009 & 2010, but as you can see at the bottom of the page, it was updated on 6/15/2011. Soooo??</p>

<p>I've found information on proposed legislation from this past Spring (HR 529) that would have extended the provision to 2011, but have not been able to determine if it ever was passed into law?</p>

<p>I know that computer expenses that are "required" by a school are still allowed to be used for 529 expenses in 2011. I would really like to determine "with certainty" if the 2009 & 2010 stimulus bill provision which allowed these expenses whether required or not, has been extended for 2011?</p>

<p>My 529 guy said that expenses are rarely rarely audited, but that it is easiest if the checks are clearly educationally related. thus, if you have a choice between paying for a car and paying for a computer, pick the computer. Easier to defend, especially if the other receipts clearly show that the student is attending an educational program. </p>
