<p>I would like to take tuition deduction for S. Ex & I trade off on claiming S as dependant. For years he is not mine to claim, can I not claim his tuition as a deduction? Ex is paying nothing toward S's college (he has been unemployed for over a year)</p>

<p>No. For the years you can’t claim son, you can’t take tuition credits. I would suggest explaining this to ex and making tuition his reponsibility those years :)</p>
<p>Or if he won’t agree to that, maybe you can reimburse him for what he would have gotten for the exemption, with what you get for the credits. I realize it’s easier said than done to negotiate with an ex, but there’s not much else you can do.</p>
<p>3bm, that’s kind of what it sounded like from reading the worksheet. I was hoping I was wrong. After posting this, I realized S would have no tuition for 2009-2010 (I am filling out CSS for the fall for his freshman year), and 2010 is my year to claim him. So I have until 2011 to figure out something.</p>
<p>I am not sure how much you get for a tuition deduction, I’ll have to run some numbers through the worksheet. I imagine if ex filed for it in 2011 he’ get more money back, as his household income is much less (hoping he is re-employed by 2011!)</p>
