My son was called for jury duty December 2016 just before he came home for Christmas break. He notified them that he was away at school and wanted to delay it until Christmas break (2 weeks later). They were not very thrilled but with a second letter and copy of his schedule along with a school calendar proving when UMD’s break actually was, they finally agreed to postpone it to his break. He served his week in January, 2017. Well, here we are just a little over a year later and he is called for jury duty AGAIN! This time it is right AFTER UMD’s spring break. He could try to delay until summer, however, he begins his dream internship in NYC almost immediately after school gets out. I’m all for doing our civic duty, but for a college student to serve jury duty twice in 13 months is a bit too much! Add to that, he is only a junior so he may very well have to figure this out again next year based on how things have been going. Any suggestions on how he can navigate this would be greatly appreciated. We are about an hour and a half or more from campus.
You may want to call the Clerk of the Court, or check their website. In some jurisdictions, you can only be called for Jury Duty once every 3 years.
Did he actually DO jury duty?
@SoofDad and @Sybylla our county states: Notwithstanding CJ § 8-310©(2), an individual may be summoned for jury service after 1 year if the individual serves on a trial jury for fewer than 5 days in a 3-year period." Because he was not actually called in all 5 days, it seems to me that the 3-year period won’t apply to him, even though he had to be available for all 5 days. So a year ago, he/we had to make sure he could commute in the event/when he was called in to serve for that week. (He doesn’t have a car.) This meant arranging transportation the night before because depending on traffic it could take him anywhere from an hour and a half to 3 hours to get to the courthouse. (This is no exaggeration - the time it takes us to get to UMD truly does vary that much.) Now, here we are again, a little over a year later and back in the same position, but even worse due to the timing being after his break will have occurred and the out of state internship starting right after school. It’s just frustrating and seems rather unbelievable that the jury selection is truly random. Oh well.
I would still recommend calling the Clerk of the Court to see if something can be worked out, perhaps another deferral.
You should just have to provide proof of enrollment and class schedule for duty during school…Does he have the internship offer in writing? If so, that proves he is committed to being out of the area during the summer. Perhaps if you request deferment to week after expected graduation, they will honor that…?
@maryversity He does have the internship offer in writing. He will call them on Monday as @SoofDad suggested and see if they will excuse him, but we aren’t too hopeful based on last year’s experience. Right now, his current plan I believe will be to ask to be excused first, then if they say no, he will request to be deferred to the week after his last final. Unfortunately though that will mean changing his move-iin date for when he moves to NY as his current plan was to move immediately from UMD. I can’t remember his start date but it was VERY soon after the last final. It will work out - it has, too. I think right now we are so irritated since it has been barely a year after his last summons. Oddly, I have only been called once for jury duty and that was about 20 years ago.
I agree that it’s ridiculous…
