Actually after thinking about it a little, I did not address the original poster’s question.

NCP does not file FAFSA, and it is not his responsibility how accurately the FAFSA is filed.
Some schools require NCP Profile to be submitted in order to apply for Aid at that university.
NCP has a legal right to refuse to provide NCP Profile.
The school that requires it simply assumes that the financial aid application is not complete, and the student will get no financial aid unless he/she is able to get an NCP waiver.

I believe such a waiver is very difficult to get, and would normally only get it if there is true non-contact, which does not seem to be the case here.

Bottom line is NCP can simply do nothing, his daughter cannot blame him for anything, since that is what his daughter wants him to do. He himself would not be doing anything improper.

I hear of more cases of Children begging their NCP to provide an NCP Profile than vice versa. Because if NCP Profile is not provided, they get no aid.

But FAFSA and the EFC isn’t based on what you WILL earn or receive, but what you HAVE earned or received. There is not a question about how much money you will earn in 2015 or 2106, but what your 2014 earnings were. The EFC is not based on speculation while the CSS might be.

This discussion has been so helpful. I think it is easy to believe that if the ex can lie on a petition for waiver for NCP, than she can just as easily lie on her tax returns. But it is also about his daughter who completed the request for waiver and did not depict an accurate portrayal of the Dad’s financial support of his daughter or the time he has contact with her. It is just a sad situation all around. If the system does not catch this then I am afraid the consequences will be more difficult for his daughter. Thanks for all your comments.

Yes…the consequences will be huge. But for the waiver, there will need to be sufficient evidence that this parent is out of the picture entirely. That would mean others would need to lie as well.
