My uncle just finished his PhD from California… waiting for his commencement (graduation) happening in may…he came to US with F1 visa and now he was asked to leave the state as soon as he is done with his commencement.
I will like to know options available for him to stay in US ,his wife and children are with him here.
If he does not have a job to go to that he can use his OPT for, and he doesn’t have a post-doctoral appointment to go to, then he has to leave. That is not news. He was given this information when he applied for his student visa.
If his wife is also a student, as her dependent he can convert his F1 to an F2 for the remainder of the time she is studying here and through any OPT that she uses.
Who asked him to leave, how, when and why?
You say that he was asked to leave “as soon as he is done,” which makes me suspect that your uncle’s situation involves some sort of status or immigration violation. Otherwise he would have a 60-day grace period after the completion of his program to leave the country.
If your uncle’s situation does involve a status/immigration violation, and he wants to preserve the option of living in the US in the future, he needs to speak to a qualified immigration lawyer. As soon as possible and definitely before leaving the country. (There are situations where a visitor would forfeit their right to an appeal by departing, and any negative determination would remain on their immigration record and may cause problems for future visa applications.)
