Residence for In-State Tuition at UC

My son lives with me (his father) and attends high school in Virginia. Once he graduates, he will immediately move to California and establish residency with his mother who has been a life-long California resident. This will occur well before his 18th birthday.

UC regulations are fairly clear that if a student establishes residence before his/her 18th birthday with a parent who already has legal residence in California, then the student will be eligible for in-state tuition.

However, if my son applies to a UC and is accepted while a senior in high school (in Virginia), he will likely have to submit a Statement of Legal Residence (SLR) by May of his senior year. At that time, he will still be residing in Virginia, but once high school ends in June, he will immediately move to CA and establish residency as a minor with his mother (long-time CA resident).

Based on the scenario described above, will my son be able to qualify for resident tuition freshman year? And, if so, how should we handle the SLR with submission required in May?

Thanks!
