Teacher Not Honoring Extended Time

Okay, so my math teacher always gives us these ridiculously long tests and quizzes that no one in the class has time to finish. He will usually allow EVERYONE to take 15 minutes after school to finish the test/quiz and will not budge when I ask him for the time and a half that my school has given me due to my ADD. His excuse is that he already extended my time by about a time and a half, but I think that he is wrong. I am not really getting extended time if everyone is, I am getting the exact same time as everyone else. He will then typically say that the 1st student handed the test in at the 45 minute mark (an Asian who always finishes 15 minutes ahead of everyone else) and that I have had a time and a half since then.

Is he legally allowed to do this? I thought that the Americans With Disabilities Act made it illegal to discriminate against people with documented problems.

I’m not sure about the legality, but it doesn’t sound fair either. If the teacher isn’t budging, try taking it up with the head of the math department or the (vice) principal. Getting a parent/guardian involved would be helpful, as they’ll probably treat the case more seriously.

Your teacher is definitely out of bounds. Do you have an IEP or a 504? If an IEP you should take it up with your special ed coordinator, if a 504 it’s usually your guidance counselor. I would try first yourself (good practice in self advocacy) and if necessary ask your parents to step in. Good luck and let us know what happends.
