Can you lose instate status?

I have never thought about this and when I searched CC I didn’t find any related topics…

My parents are moving in the fall and it will be out of my current state. I have applied and been accepted as an instate student but when my parents leave the state(and stop paying state taxes) will my status change to out of state? The tuition differences are HUGE! I know you can gain instate status but I’ve never heard the opposite… anyone know?

Thanks!

What happens or what you need to do will depend on the college and state you are in. For many, once you are enrolled as a resident, if your parents move, you will still be treated as a resident for tuition purposes as long as you remain continuously enrolled in the college (every fall and spring semester) through the first degree program (your BA or BS). Others, you may be treated as a resident for only an additional year or possibly only to the end of the school year in which the move is made. However, you can potentially get around that issue by actually setting up your own residency in the state. An out of state student usually cannot do that but an in-state student usually can because you begin with a presumption of residency. Thus, if, when parents move, you set up a permenent address in the state (like with another relative), continue to vote there, continue to have your driver's license there, bank account there, and things like that, you may be able to maintain your resident status. However, in that situation, you may also have to become separate from your parents for purposes of filing taxes and thus they may have to give up any deductions involved that they would get by claiming you as a dependent. In essence, the first thing you need to do is find out what the rules of your college are so you can then determine what you may need to do.
