Filling out 2009 - 2010 fafsa. Separated 8-2008, divorced 5-2009, filed joint return with ex for 2008 tax year. When I do the fafsa and it asks for 2008 tax return information do I use the joint numbers or split them as if it were a separate return. Later in the process, after it asks for marital status the form only requests my income numbers.

I had the same issues. I spoke directly with FAFSA representatives. Use only your income. Any assets, split in the same ratio as your income is to your ex’s. In my case I made one third of the income and I also then entered one third of the assets. I was poor enough that one year for son to qualify for $5800 in grants. The following year I worked more and had larger amount of the assets and no more grant.

As Lucy said, your income is determined from you W-2’s, 1099’s, etc. without regard to your ex-spouse. I believe that since the divorce is now final, you will simply supply asset info on those assets that are actually in your name. Asset valuation for FAFSA is determined on the day FAFSA is actually filed/amended.
