Hi All,
My wife is from Mexico and we got married in April 2018 here in California and we immediately submitted her i-485 application the same month for her green card and she also received her work permit EAD card the same month. She didn’t receive her green card until April 2019. For her FAFSA application should she put that her date of legal residence as April 2018 or April 2019?
Thanks for your help,
Aaron
To clarify it states “When did you become a legal resident of California?”
The question on the FAFSA is just to college information on the FAFSA. Some states require more questions, especially if you met the simplified assets test. California will have its own set of forms and documents for how long she’s been a legal resident.
Okay thanks. Also for the income section, it’s a little complicated to answer. Since it is asking for income in 2017, do we put:
For 2017, have you completed your IRS income tax return or another tax return?
Not going to file (since we were married April 2018? she was in Mexico at the time and did not file taxes down there)
How much did you earn from working in 2017?
Can she say $1000 because that was approximately how much she made in 2017 in Mexico?
How much did your spouse earn from working in 2017?
Can we say $0 because we were not married yet? Or do we put down my salary from 2017? If we put my salary, it does not allow us to answer the first question as “Not going to file”
I think you have to call and ask for help. I agree with your answers that they should be 1. not going to file
2. The amount she earned no matter the source (so $1000 if that’s what she earned)
3. Your salary
But if it won’t let you do that, you are going to have to ask. You aren’t the only people who weren’t married for 2017 taxes but are married now when you are filing.
