Grade Appeal Advice and Feedback

I am currently appealing a grade received in a Macc program. For this class, the syllabus states that an A is 90-100, a B is 80-89, a C is 70-79, D is 60-69, F is 59 and lower. The class is not graded on a set curve and the grading is non-competitive. My final average in the class was an 87 and I received a final grade of B. This was the highest grade in the class. This in and of itself is not a problem for me as no one is entitled to an A nor is an instructor required to give one.

The issue is that only 2 other students had averages higher than an 80 yet 15 students received B's in the class and 5 received C's. The instructor has either curved the final averages for numerous students with averages below 80 or he lowered the grade band for a B to something below 80 and for a C to something below 70. A couple of students with low 70's averages received a B. The worst performing student in the class received no grade on any assignment higher than a 60 yet he still received a C. So there appears to be a rather hefty curve upward for some students or a significant reduction in the required grade for B's and C's. However, this curve either not applied to students who actually earned their B's or the grade band for an A was not lowered along with the other grade bands.

After meeting with the department chair, who would not officially comment since my teacher has not formally responded since he is not under contract again until July, he implied that this was going to fall under academic freedom and this issue would not be well received due to "far reaching ramifications".

Has anyone else appealed an issue like this? Were you successful? Any advice on how to better frame the argument that not all students were treated equally? Any constructive criticism?
