in state tuition?

I work for the DOD and am on orders overseas. I am not active duty, I am civilian. I have custody of my children and receive child support for both. They are both dependent ID card holders of my retired Air Force Ex Husband. My daughters spend summers with their dad in California, who owns two homes there. My oldest has her driver’s license there and has registered to vote there. She was recently accepted into UC Davis and they say she is not a resident. My husband is paying for their college education. Please tell me how to make it so they are in state residents for tuition.

California is desperate for OOS tuition from OOS students.

The problem is that your EX has not been the custodial parent. Since he pays California taxes, and he’s retired military, he needs to speak to the residency committee (and he would have to submit paperwork beyond California Tax Form 540) on their behalf.

If you are DOD and non-military, you can’t presume that the State will accept your non-residency status because you are not a resident of California. It’s all on him and his W-2, tax documentation, local property taxes, and utilities’ payments-in his name- for your daughters’ proof of California residency. Everything has to be in his name. Yes, they are very strict about documentation.

Since the eldest will be a resident, she needs to show proof of her voter’s registration card, and her California driver’s license.
