<p>This is a thread for kids in New Tork state who are on mock trial. What does everyone think about the case?</p>
<p>The case is different. We just started going over it tonight. Even after some quick review it seems to have a TON of holes (ie the contract). It should be fun though.</p>

<p>I'm an attorney for the plaintiff at my school and I'm examining Macca(did you notice that some of the names are incredibally stupid-Robin Rabin, Andy Anderson etc..>) Anyways, I'm currently working on applying the case law to my closing(the prudent investor act, guidelines for a fiduciary/trustee, etc..) If you need any advice on your case please let me know, and I'll do the same if I run into problems. Thanks</p>
<p>i'm doing the plaintiff and defense on this case. i like it, but i find the names annoying, and i really think it's slanted toward the plaintiff.</p>

<p>i wanted to use the lee ann rimes case, but my teach said we couldn't use outside cases in closings.</p>
<p>...it's awful, because everything is way over the time limits imposed...my cross of Robbie is 60 questions long!! ack!</p>
<p>Yeh, the cases are always full of weird mistakes and holes; we just got the correction packet explaining that Macca is of course 18, not 19 as she says in her affidavit! It's a cool case, though: one side LOOKS really easy and winnable, but as you look at it the other side has a ton of caselaw and evidence on its side. Speaking of evidence though-- what's with the stupid letter from her parents? and the agreed-upon financial statement's a little sketchy as well...</p>
<p>i think the letter is useless. the only point in bringing it up is the plaintiff in its closing, saying, why the heck are her parents writing her this? don't they have the decency to tell her to her face? </p>
<p>and I don't know why you would enter the contract either, unless you wanted to specifically refer to parts of it. </p>
<p>I find it so annoying how everything comes out under Macca and Robbie. the other witnesses add stuff, but the bulk of the info is under those two. it's impossible to keep to limits!</p>
<p>The Prudent Investor Act is very important. The 2 main points id think that you'd want to bring up are the ones that say all trustees should diversify their portfolios if they chose to put the money in the stock market, and 2nd they must consult all necessary sources before making the investment. As far as Macca goes, she is just telling the story but isn't an expert on case law. I'm guessing Robin Rabin(horrible name) is the one who will be able to explain that.</p>

<p>would you say that crossing Robbie on his knowledge of the Prudent Investor Act is good or bad? because he is the fiduciary, and I feel like he should know what's in it.</p>
<p>I don't think you should ask him about the prudent investor act, but what you can do is ask him what steps he took prior to deciding how to save the money. Once you establish his testimony as evidence, you can talk about how that applies to the law in your close. Look at b-3, A, B, C, and D of the Act. Im sure that will help. In addition, it might be benifitial to look at the Meinhard v. Salmon case as well as the one that dealt with diversification(I cant remember the name) Good luck!</p>

<p>i'm crossing Robbie...dude, mine was like 70 questions long when i started. it's now around 40, and just within time limits. sooooo hard!</p>
<p>definitely on the Prudent Investor Act, and whether the investment of money into one single account was reasonable.</p>
<p>That's a bit of a conclusion on the part of the witness, don't you think?</p>
<p>if you can keep hammering away at "did you look into [other type of investment], or this type, or that type, or this" and then be like "you invested it ALL in ONE PLACE" and then be like "did you invest your OWN money in this IPO?"</p>

<p>hey everyone! I am also directing Macca/crossing Robbie/doing Closing. I'm actually fine with the cross questions. I'm doing closing now, which is tricky but fun. It's tricky because there's so much information we can use and so little time! If anyone is willing to talk MT let me know :) hehe</p>
