Question regarding FAFSA

I'm posting this question here, as it seems that other parents might best know the answer to this.

My husband and I are in the process of getting divorced; by the time we file a FAFSA, we will have filed the divorce papers (state of CA), and living separately.

As far as the FAFSA is concerned, as long as we've filed the papers in 2009, can we indicate that we are "separated" (I realize that it takes 6 mos. for a divorce to be finalized, so that's not an option).

Appreciate your help very much - thanks!

Marzies, I think you’re correct, but I would suggest searching the financial aid forum for confirmation.

You can indicate that you are separated at the time you complete the FAFSA form. The earliest you can submit is Jan 1. So if you separate this year then you are “separated”.

For instance:
If you complete the form on Feb 25th and the spouse moved out on the 24th of Feb then you are “separated”. If the spouse doesn’t move out until Feb 6th then you are “married”.

Also note that if you are separated but filed your taxes jointly - then you will only include your portion of the income/tax information from your tax form on the FAFSA.
Use only your W-2, only your portion of any joint bank accounts and report only your portion of taxes paid etc.

Thanks so much. I appreciate it.
