i got suspended just recently for petty theft / conspiracy. i dunno im a pretty smart kid with decent grades and i am a sophomore. i mite have to go to court for this… i did not do anything and the charges might be dropped… help me… will this affect my chances of getting into good schools like the UC’s perhaps?
<p>nope don't worry..i got misdemeanor for three different counts of drug possession and i'm headed to ucsd. convicted or not UC's won't care about your criminal background.</p>

<p>if you go to court..try your best not to get convicted cuz you can get your record cleared when your 18. try your best not to get fingerprinted. if you do that goes into FBI database and dat **** is impossible to clear.</p>

<p>ouch. still you might be able to avoid conviction which is good for regular employment. you might have to explain yourself and clean up your act for government jobs and other highly sensitive positions.</p>
<p>hm.. so it doesnt get erased if the charges are dropped? cuz im only 15 and the guy that got his thing jacked said that he would drop the charges when we meet up with the District Attorney... HOWEVER there is a guy that jacked the thing WITH me and he said I did it ALL which is complete bs. he hired the "best lawyer in cali" which is also bs... he told his lawyer... BS... so these things dont erase when your 18?</p>
<p>it's a really complicated process. yes if the charges get dropped..and you stay clean until 18, you will have to pay $100 and MAYBE have to go in front of a judge to get your record cleaned. this will clear it on a district and STATE level i believe. HOWEVER, if your ass got fingerprinted and it got sent out on to FBI...your basically screwed if you want to get it cleared on a federal level.</p>
<p>typical, if you do get fingerprinted, it's going to the database and it'll follow you forever. it'll help if your not convicted though cuz you don't have to digress the information to employers. if they do check ur record and ask you can explain yourself and they'll likely give you the benefit of the doubt</p>
<p>i didnt get my finger printed yet... and i heard it was mandatory from my student conduct person at school so im confused as hell... some people are saying not to trip because the case itself might be dropped because the juvi probation thing is backed up 6 months or something... and it is PETTY theft</p>
<p>hmm..that sounds a lot different. what state are you from? i know in california: fingerprinted = straight to the fed. for some reason though, the way your explaining this it sounds like if your case is dropped, it might not go to feds</p>
<p>sad thing is i didnt do anything. the only reason i got charged for petty theft is because the other guy said i did it... really the guy took it and threw it away (an ipod by the way)... now hes coming up with bs to cover it up</p>

<p>well, i was trying to get my record cleared today so i talked to a police officer friend of my. it turns out, the situation is alot better than i've been told. even if you've been fingerprinted...if you've been fingerprinted because of something you did as a minor, your record can be expunged when your 18. however, you have to have a reason to have your record sealed or expunged (job application request if you have been arrested, school has requested if you have been arrested). if you are appealing in court for precautionary measures than they will decline your request to have your record expunged. my advice, when your 18, go around looking for job applications that ask if you've ever been arrested (it doesn't matter if you plan on taking that job or not). than explain to the court that your desire to acquire this job has caused you to request your records be expunged from the court. it will cost $100, but your request will be granted. </p>
<p>there are two ways you can seal a record. one is to expunge it. one is to seal it. if you expunge it, it'll be gone, over, finito for the rest of your life. if you have it sealed...a court order in the future can bring it back up. my recommendation, get it expunged.</p>

<p>Please get legal advice and fast in order to get the best advice possible. You need to try right now to get the least punitive response from the court possible. You don't want to go with the With'im Defence. ("I didn't really do that, I was only With Him...") You don't want to be totally at the mercy of the other guy's version. Don't take advice on legal matters from our Board readers. You have not mentioned your attorney!! That is the most important next step you could possibly take. That and assuming responsibility for whatever you did, expressing remorse, making restitution, and making sure you are employed somewhere part-time or volunteering somewhere. Get other adults who believe in your potential behind you. Hang with friends who have good judgment. Good luck as you sort this out.</p>
