To apply as freshman or transfer?

I graduated high school with a sub-par GPA (I'm not exactly sure what it was but I believe it's around 2.5) and I've been studying in Canada now for two this (this being my second). I'm not happy with the way things are going here and I'd like to move back to the States (I'm an American citizen).

My plan is to spend next semester here and if I can manage to get A's in all of my courses then I'll know that I am, in fact, ready to be in college and that my bad grades are solely a result of my laziness. If this is the case then I would like to apply to UCF -- I plan on applying to a community college regardless.

Would I be better off applying as a transfer student (with less than 60 credits) or not mentioning that I've attended secondary school and applying as a freshman?*

I plan on retaking the SAT soon. My original score was ~2100.

*I'm honestly not sure whether this is legal or not.

I would (and have myself) go to valencia CC then transfer to UCF.
