Undocumented immigrants are not actually banned from attending colleges like Georgia tech they are restricted from 8 us code 1621 which means if they apply for a state benefit like admission to Georgia tech they will be considered inadmissible for a future green card benefit.
They aren’t banned from attending all colleges but they are actually banned from attending certain colleges like Georgia Tech.
In October of 2010 the board of Regents put into effect a law that bans undocumented students from enrolling in the state’s most popular public colleges. These colleges include the University of Georgia, Georgia Tech, Georgia State, the Medical College of Georgia and Georgia College and State University. These colleges stopped accepting undocumented students beginning fall semester of 2012.
This policy is referred to as 4.1.6. It is worded as follows:
A person who is not lawfully present in the United States shall not be eligible for admission to any University System institution which, for the two most recent academic years, did not admit all academically qualified applicants (except for cases in which applicants were rejected for non-academic reasons).
And this is 8 us code 1621 if you to their website it will have a save verification which is used for state benefits.
I guess it might apply if you were attending the state school tuition free (due to the state paying your cost of attendance or at least tuition) but it doesn’t ban undocumented students from attending all state schools.
It also provides that states can enact their own laws regarding eligibility.
(d)State authority to provide for eligibility of illegal aliens for State and local public benefits
A State may provide that an alien who is not lawfully present in the United States is eligible for any State or local public benefit for which such alien would otherwise be ineligible under subsection (a) only through the enactment of a State law after August 22, 1996, which affirmatively provides for such eligibility.
This is simply a rehash of previous incorrect information the OP has spouted. While there are many colleges and universities that an undocumented immigrant can attend, GTech, or any public college in Georgia, are not among them. As the inaccurate information in the initial post will only spur debate, I am closing the thread.
