URGENT! Good or bad idea?

Okay, so I graduated in 2008 and for the past year I attended a community college however, I did poorly for personal reasons. I planned on transferring to a University after taking a year or two at the community college but there's really no point in transferring since it's not really going to make a difference and only hurt my chances. For the application I'm filling out for the University, I am applying as a Freshman instead of a transfer student because I don't want to use my credits. On the application, there's a separate section for Transfer Students asking to list the colleges that you've attended. If I'm not going to be transferring any credits do I need to put the community college down? I'm afraid it's going to ruin my chance of getting accepted. Is it like illegal to apply as a Freshman if you've been to a community college before because I really just wanted a fresh start. I know I can do it, I just had a lot of things to deal with. Also, there's a question that states have you ever been dismissed from a college or school before? My records from my community college say subject to dismissal so how big of a deal is it if I were to check no? If they assume I'm a freshman are they going to know I went to a community college?

I think it’s better to say that you attended community college. At least they will then know that you did something in that gap between now and when you graduated high school.
