you my friend are confused. I am sure you mean well but you are confused on the law.

i admit i dont know the law the best, but i can interpret it well enough to defend my self in court against a long time eviction attorney and win (mainly his clients fault they didnt follow proper procedures for notification etc etc...) But maybe you should look for yourself before you say anything. General consensus is that graduate schools want to know everything from moving traffic violations to arrests but no convictions. But for undergrad they just want to know convictions. This is coming from houston law school etc etc..a few others that randomly popped up but i didnt recognize the name

All in all, this is based off of applying to a job at a business, just my opinion thinking that is could possibly transfer over to an application for school............
but again schools have their own policies and best to ask them or find info on web site

But hazmat, since you seem to look down upon everything i write, why dont you prove me wrong?

Ahhh yes, the general consensus... a phrase that serves as a poor excuse for not citing a single source.

so you want to laugh at what, i was evicted becuase my rent was 2 days late, i am so sorry. General consensus you idiot becuase what, i did a search for a few minutes and schools that appeared are not related to duke or anything close to it, they a general examples. St mary, stetson, houston school of law UNH and HR of U wisconsin. I have to generalize because it doesnt really do anything becuase it is not DUKE. I am generalizing becuase as i already said my info is mainly based off applying for jobs.
This is just random stuff that may or may not match dukes policies

Here is info from UW, again not dealing with applications

Policy Statement

Pursuant to Wisconsins Fair Employment Act (§ 111, Stats.), it is unlawful to discriminate based on arrest records or conviction records of applicants for employment.

ARRESTSApplicants cannot be excluded from consideration disclosed or not based on arrest record unless there are pending charges that are substantially related to the circumstances of the job.
CONVICTIONSApplicants cannot be excluded from consideration based on convictions unless the conviction is substantially related to the circumstances of the job.

Because employment can be a key component of rehabilitation, each agency should make a strong effort through its own hiring actions to demonstrate the feasibility of hiring persons with arrest and conviction records. However, at the same time, the agency has a responsibility to the public to ensure that programs are carried out in a legal, effective, safe, and humane manner.

For more detailed information on securing Applicant Arrest and Conviction Information, please refer to the WI HR Handbook Chapter 246. Although the HR Handbook does not specifically cover unclassified staff, the Office of State Employment Relations does provide useful information for the hiring process.

For specific concerns about potential new hires, contact Administrative Legal Services
at 263-7400. In addition, refer to the Search Handbook for appropriate and inappropriate interview questions

Ok enought if me talking about stuff that may or may not be true. Question for the OP, If you want to know what is really on your record, go to the police station and ask a supervisor or sergant, explain to them your situation. I dont know if you went to court or not which is the main question that needs to be answered. If you mean arrested as in your were arrested and they let you go and you never went to court that is fine, if you went to court, then you will have a complaint filed. But if you werent charged there should be no formal arrest on your record, but it is your responsibility to go to the station to find out yourself. If there is a record, it can be expunged, but that takes time (3months to a year)

What they don't know won't hurt em. They don't do background checks on you

The charges were dropped. I don't see how this is a big deal. And if they do a background check, they WILL find your arrest. If you were arrested and charged, that meant that some paperwork was filed.

well a cop told me if he didnt go to court there is no record period, if there is a record, the cops made a mistake and they will clear it up at the station he was detained at. If he did go to court there will be an arrest record showing no convictions

Assuming this is true....

He could still get kicked out of the college, even if he got accepted. Say he has some jaded friend or ex who decides to provide a tip to the school, or they just happen to find out - then he gets kicked out, and has mention that if he applies elsewhere. It's better to just say it and get it over with. If is application is strong, then they will not pay too much attention to it.

don't say anything

they can't find anything out if you weren't convicted.

better yet, don't apply. Apply to Brown or UC Santa Cruz.
