Arrested?

<p>On the duke supplement it asks, other than what you reported on the common app, have you ever been arrested or placed on probation, regardless of the outcome? I have no idea how to answer this because i dont know if what i did really counts as being arrested. I was taken into the police station for underage drinking and they called my parents to pick me up. I was not charged, and they did not put any information about the incident on my record. Does this count as being arrested? Thx for the help</p>

<p>I would not be so sure about that at all. If you were "taken into the police station" against your will by a police officer investigating a crime, that sure sounds like an arrest. You might have been released without charges, but that doesn't mean that an arrest didn't take place.</p>

<p>Did you voluntarily go with the officer to the police station, or were you physically restrained and/or verbally told that you were placed under arrest?</p>

<p>I also would not assume there's no record of it.</p>

<p>I would suggest contacting the police department in question and ask to obtain any written reports that might be extant.</p>

<p>if they just picked you up, took you to the station, and let you go, then youre fine.</p>

<p>its not like theyre going to document it AFTER youre released. what the hell is the point of that.</p>

<p>Even if they wrote in their log book that you had been warned not to let this happen again, that doesn't mean you were arrested. This does not count as being arrested.</p>

<p>You could also ask this in the parents forum and get an answer - some of the parents are lawyers :)</p>

<p>I dont think they wrote anything...I think the only thing that happened was that my parents had to sign something that said they were taking me home. not sure about if they signed anything tho. Just tryn to remember as best as i can</p>

<p>If you parent's signed something, then there may be a documentable paper trail. Talk to the police department where it happened and see if it was logged as an arrest or is on your record in any way.</p>

<p>Bballer...all it takes is a phone call or a visit to the police department. Better to be safe than sorry. If it is on your record and you state that you had no arrests, the institution will take it as a lie. If you include it on the application and it isn't on your record (hence, not an arrest) then you may get overlooked. Don't take any chances...find out for sure.</p>

<p>Duke has to deal with almost 20,000 applicants and only accepts 3,000. I don't think they have time to look through all 20,000 records with the police. If you have good grades, they probably won't be suspicious. But what's the worst that can happen, you wouldn't get accepted? So do 17,000 other people. Do you think you have a really good chance of getting accepted into Duke? It's so competitive, it's like an Ivy League.</p>

<p>Did you have handcuffs when he took you in? Did he say you're under arrest? Colleges have to deal with underage drinking all the time anyways, and Duke is one of the universities that wants the drinking age lowered to 18 so they don't have to deal with this. But in all honesty they probably won't look into your so much to make sure you didn't get arrested when they have so many aspects of you to focus on and 20,000 other applicants.</p>

<p>they cuffed me lol but they never said "you are under arrest. " They just said alright your coming with us to the station and we are gonna call your parents. I dont even no why they took me in. I have many friends who have been in the same situation and the cops just took em home.</p>

<p>To be arrested means for them to take you into custody. It sounds like an arrest to me because they handcuffed you(but probably see way too many underage cases, maybe they didn't feel like saying you're under arrest), but if they also didn't say stuff like you have the right to remain silent, you never know. I mean hey, put it and you probably won't accepted. Don't put it and you still might not get accepted because Duke is so competitive. What's the worst that can happen? You wouldn't get accepted either way unless your grades and SAT/ACT scores are really great(in which case they wouldn't suspect you of being arrested). but don't forget that if colleges find out later, they can kick you out even after you've been enrolled and you're already taking classes.</p>

<p>the main question is (and im surprised no one on CC has said this) did they read your miranda rights. If they did not say "you have the right to remain silent, right to attorney, etc" it is not an arrest. Also if they didnt book you (ie take your fingerprints, mug shot, etc.) there will be no paper trail. you will not be in the system. DO NOT MENTION THIS. yes you may be lying but think of it this way "you were intoxicated you may not remember the arrest" All this will do will hurt your chances.</p>
