As a postgrad (high school) gap year student, am I eligible for CommonApp fee waiver?

My annual family income falls within the Income Eligibility Guidelines set by the USDA Food and Nutrition Service. So according to the requirements, my financial circumstances qualify me for an application fee waiver.

I have requested fee waiver through my common application account, but when my counselor was submitting, the system wanted him to verify that I am currently 11th or 12th grade student in the school. Since after graduating from high school I took a gap year, I am not enrolled in the school now. But since my counselor still knows my financial situation, he submitted the fee waiver request anyway.

Now as a postgrad gap year student, am I eligible for CommonApp fee waiver?
If I am why it wants my counselor to verify such thing?
If I am not isn’t it unfair for students who take gap year?
Can my counselor withdraw his submission and if he can, should he?

I am in the same situation, except my counselor is refusing to be any help. I ask CommonApp over live chat once. They said that I had to contact the admissions office of each college that I am applying to and find out their policy as well as any additional information that the school may require. However, I have actually not done this yet since most schools are on break. So, I don’t know how reliable this information is or how the process would work exactly.
