Ok, went to college ended up failing out. But I have now decided to go back to school, however for a different major at a different school.

I have decided to do 2 semesters at a community college to get my GPA and help show the new university that I'm serious about it. However, I'm not sure about the previous college credits and whether they will be able to transfer because of my low GPA <2.0.

I found this on the college that I plan to transfer to...
"Students transferring credits must have a minimum 2.0 cumulative grade point average (GPA) in all course work presented for transfer from each institution attended."

Now does this mean the original credits I took are now useless? Or do I have to retake them or something?

As long as you passed the classes, and you have a cumulative (total average GPA from ALL classes you took/will take) of 2.0 or greater, then they do count. Classes you fail do not count.

Oh so as long as I have a GPA of higher than 2.0 from both institutions combined I will still get the credits from the first institution with the GPA below 2?

I think as long you have a transferable GPA of 2.0 and all courses you have taken should be counted, except "F" because you get no units credits for that.

By the way, what school are you planning to transfer. Even though it say at least a 2.0 but usually you have to do better than that to transfer.

That's what I was thinking. Because if the first college credits didn't transfer, then I would take more time off and do CLEP tests to get the generals I lost and then transfer.

Yes, I know, but I went to to school failed out, then took a year off, and will do a year at CC and get 3+ GPA. So hopefully when I transfer they will see that I made the positive change and allow me in the program and upon seeing the GPA from the CC they will say "he turned around."

I just planning to transfer to a state school, a little more selective than my previous college, but if I do good it should be no problem. The only other places that had my program were private and I'm not paying that much for it.
