So here is my story. I am 21 years old and I immigrated to America about 9 years ago and have been residing in Virginia ever since. The problem is my parents have moved to MD 2 years ago. My mom however, still work a full time job in Virginia (though she doesn’t pay VA taxes since there is a reciprocity clause between MD and VA regarding non resident workers). So I live in VA, have a part time job, file tax to VA and currently in community college with in state tuition. I have a drivers license, bank acct since I was 16, registered to vote (haven’t vote yet though… this upcoming election will be my first). So will VA schools look at me as an in state or out of state student? What do you guys think?
This depends on whether you are a “dependent” or “independent” student. If you are paying all of your own bills and your parents do not claim you on their taxes (which I don’t think can be done after 18, but don’t quote me on that), and they truly do not provide you financial support, you are an independent student. Once you turn 24 you are automatically independent. If you are considered independent, then you would be an in-state student in Virginia as long as you have lived there for 12 months straight.
However, if your parents are paying your rent, mailing you money for bills or groceries, etc, you are a dependent student and you would be considered an out-of-state student in Virginia, and you would be considered an in-state student in Maryland.
Here is the link to the domicile page for Virginia if you need more explanation! I’ve lived in VA all my life so I think I explained it properly, but check the actual govt website in case I’m wrong. Good luck!
Do your parents list you as a dependent on their tax returns in Maryland?
Yes they do. I heard back from VT and I got accepted as an out of state student. So my next question is, does this decision straight across the border for all VA schools? or is it independent decisions for each schools? Because I am considered as an in state student for my application for UVA but is accepted as an out of state student for VT. Is this something I can bring up when I ask VT to reconsider or would that just make things worst?
