<p>No, don’t use 2009 taxes. If she is not required to file a 2010 return then you file FAFSA with whatever income she did have for 2010 (including child support and unemployment) and indicate that she will not file a return. This will be fine, as long as she is not required to file a return.</p>
<p>Are you sure your parent’s aren’t going to file a joint return for 2010? If they are still legally married, I believe they are entitled to. If so, she will just report her income if they are separated but use “will file” as a status until taxes are completed. Unless I’m mistaken, unemployment compensation is income for tax purposes…she should go to irs.gov and check the income limits before she selects “will not file” as her tax status.</p>
