I started working for this small company and it's been about 60hrs of work time. I was really never hired nor did I fill out any forms. He stated that he wanted me to work, and see how I do. All of a sudden the boss gets mad that I didn't vacum while he was gone once, and now he doesn't want to hire me. Along with that he doesn't want to pay me for the time I've worked. Is there anything out there, that says he has to pay me?

Here you go: http://www.dol.gov/esa/regs/compliance/whd/mwposter.htm

Yea, that still doesn't mean anything to him. What should I do now? It's not really worth the legal battle, because it would cost me more, then I would get out of it.

I would just forget about it.

It'll be Community Service then

That's awful! It seems like he's just using a little thing as an excuse not to pay you for your good work. Stand up for yourself and demand you be paid, then quit. There's not really anything to lose.

See the local DA. It may be criminal.

Well there was never a contract or tax papers, so it's his word against yours.

Might as well TRY to get something out of it.

To tell you the truth, you're screwed. Even if you were to be paid now you would HAVE to fill out tax forms. I'm sure he is not going to give you the money out of his pocket and also turn around and pay your share of taxes out of his pocket also. In order to determine what percentage of your income is taxed he will need to refer to your W-2 sheet. He can't do this if you haven't filled one out.

Just paying cash would solve the tax problem. I believe.

This is what parents are for, seriously.

Have your mom or dad (whoever is more intimidating/available) call or show up.

nothing in the office was worth 60 hours of work?

HAHA, taffy you beat me to it. I agree, do what other disgruntled, laid-off office workers do and steal, steal, steal.

Follow my link and contact the appropriate government agency in your area. As an employer, I can tell you that nothing puts fear into your heart like a government audit. I'll bet it's going to be a lot cheaper paying you off than going through that.

So by law, I am not allowed to work over 40hrs correct?

I'm not sure if you fall under child labor, but overtime (1.5X) over 40 hrs for adults in hourly jobs. Get in touch with the agency. They'll tell you what you need to know. They almost always take the employee's side over the employer. Believe me, he will be quaking in his boots.

PM me how it goes!
