<p>I'm currently a second year at UVA and my parents are moving to Virginia in the spring. However, because of the requirements we won't pay instate tuition until my fourth year. Is there anyway to bypass this so that I get instate tuition ASAP for fall 2012? My father works in Virginia and has for a very long time, but I'm not sure if he pays Virginia income tax.</p>
<p>I don’t know why Va. has such a long waiting period. But to put yourself in the best position, make sure you and your parents change everything to a Va. address as soon as possible, including voting address, car registration,etc.</p>
<p>Sorry I don’t have the info handy, but I’ve done some research on this that you could replicate pretty easily. Google Virginia tax code and residence and domicile. Essentially, if you’ve HAD a home in Virginia and have been paying state taxes, I think there’s a good case to be made that you’re a resident. (It’s predicated on a large part on whether the time spent living out of state was temporary by nature and your parents always meant to return to Virginia.) Also, yes, follow previous poster’s advice of getting everything transferred in-state asap.</p>
<p>Here’s a link to the VA tax code and residency for tax purposes. Note that residency for tax purposes may be a bit different than residency for in-state tuition. In-state status requirements for Virginia are very similar to many other states.</p>
