We are military and wondering we pay state taxes in va for over 15 years since being in military …my hubby signed up in va…was wondering are we qualified for in state tuition?..though we are stationed elsewhere …how does this work? Been reading about claiming in state tuition and paying income tax is one of those conditions…if anyone have any helpful information to ease my mind with be very grateful…thank you
Looks to me like the federal law on in-state tuition uses your permanent duty station as the basis for in-state tuition. I assume since your paying Virginia taxes your husbands permanent duty station is listed as Virginia.
Additionally the state law allows family members to remain in Virginia if unaccompanied orders and still get tuition if the military spouse is assigned elsewhere but they remain in Virginia.
So sounds like you all fall under the Federal Category (see the chart in attached .pdf) where your permanent duty station is in Virginia and you are elsewhere.
